Glossary Of Useful Terms In Legal Photography
What is demonstrative evidence?
It is admissible evidence such as charts, diagrams, and illustrations that demonstrate the testimony of a witness.
It's admissible when it's more probative, meaning sufficiently useful to prove something important and not prejudicial. Photos, x-rays, videotapes, movies, sound recordings, traffic diagrams, forensic animation, maps, drawings, graphs, animation, simulations, day-in-the-life videos, presentations, and models or financial records that show injury to a plaintiff are examples of demonstrative evidence. Witnesses can create and then use demonstrative evidence at trial. It is essential to know the opposing counsel may use the demonstrative evidence to prove contrary positions to the plaintiff.
